Terms of use
Last updated 9 October 2026.
These terms are between you and Octigma Ltd, a company registered in England and Wales, number 13529832, of First Floor, 6-7 Clock Park, Shripney Road, Bognor Regis, West Sussex, PO22 9NH. They apply to octigma.co.uk, the Octigma App, Octigma Phone and Octigma CMS.
The services are aimed at businesses. If you are a consumer, you still have the rights given by the Consumer Rights Act 2015, and these terms do not take those rights away.
The services are in beta
The Octigma suite is in beta development. Features can change, be incomplete, or be withdrawn. A label on the product tells you what is available now. Early access to Octigma Phone is not a promise that every planned call feature already works.
Figures, forecasts, campaign wording and other output are there to help you decide. They are not accounts, and they are not legal, financial, tax or other professional advice. You check anything important before you rely on it.
Accounts
You need an account for the App, Phone and CMS. You must give a working email address and keep your password to yourself. Turn on two-factor authentication for anyone who can change the workspace.
You are responsible for the people you invite, and for removing them when they leave. After five failed sign-in attempts the account is locked for 15 minutes.
What you must do
You agree that you will:
- use the services only for a lawful business purpose;
- have a lawful reason before you put someone else’s personal information into Octigma;
- send marketing email and text messages only to people you are allowed to contact, and honour unsubscribe and STOP requests;
- tell people, in your own privacy notice, if you measure email opens or clicks;
- not upload anything you do not have the right to use;
- not try to break, probe or overload the service, or take data from a workspace that is not yours.
You must not use Octigma to send unlawful, misleading or harmful content, including content that targets children.
Personal information
Our privacy notice explains what we collect on our own account. For the customer, caller, lead and booking information you store, you are the controller and Octigma Ltd is your processor. We process that information only on your instructions, to provide the service, and we use the companies named in the privacy notice as subprocessors.
You will deal with requests from your own customers to see, correct or delete their information. We provide export and erasure tools so you can do that. You will tell us if you discover a personal-data breach in your use of the service.
Inky
Inky can draft text, summarise figures and read a voice note or photo you submit. You review the result before you send it or act on it. You are responsible for what you publish or send. Do not put special-category information, such as health data, into a prompt unless you have a lawful reason and the product says that use is supported.
Price
While a feature is offered in beta it may be free. When a price applies, we show it before you turn the feature on, in pounds and excluding VAT unless we say otherwise. Text-message charges, where switched on, are the prices shown in your workspace for the number and for each message.
Card payments for a booking are taken by Stripe. You are responsible for the price you set on a bookable service and for refunds you agree with your customer.
Our software and your content
We own the Octigma software, the Inky name and the look of the services. We give you a licence to use them while these terms apply. You own the content and data you put in. You give us permission to host, copy and display that content only so we can run the service for you.
Availability
We aim to keep the services available, but we do not promise uninterrupted access during beta. We may suspend access if we reasonably believe these terms have been broken, if we need to protect the service or other customers, or if a connected provider withdraws access.
Our responsibility to you
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that English law does not allow us to limit.
Subject to that, we are not liable for lost profit, lost data, or loss that was not reasonably foreseeable. Our total liability in any 12 month period is limited to the fees you paid us for the service in that period, or £100 if you paid nothing. You should keep your own copies of anything important.
Ending the service
You may stop using the service and close a workspace at any time. We may close a workspace if you break these terms and do not put it right within a reasonable time after we ask, or immediately if the misuse is serious.
Closing a workspace does not by itself release a rented text-message number. Switch that add-on off first. Clauses that should survive, including those on personal information, intellectual property and liability, continue to apply.
Changes to these terms
We may update these terms as the beta develops. We will change the date at the top and, if the change is material and we have your email address, we will tell you. If you keep using the service after the new terms apply, you accept them. The current terms are at octigma.co.uk/terms.
Law and disputes
These terms are governed by the law of England and Wales. The courts of England and Wales will hear disputes. If you are a consumer living in another part of the United Kingdom, you may also use the courts of the country you live in.
